For a complete description of the scope of the <E T="03">Order, see</E> the Issues and Decision Memorandum. <HD SOURCE="HD1">Analysis of the Comments Received</HD> All issues raised in the case and rebuttal briefs are addressed in the Issues and Decision Memorandum. <SU>5</SU> <FTREF/> A list of the issues which parties raised, and to which we respond in the Issues and Decision Memorandum, is attached in the appendix to this notice. The Issues and Decision Memorandum is a public document and is on file electronically via Enforcement and Compliance's Antidumping and Countervailing Duty Centralized Electronic System (ACCESS). ACCESS is available to registered users at <E T="03">https://access.trade.gov.</E> In addition, a complete version of the Issues and Decision Memorandum can be accessed directly at <E T="03">https://access.trade.gov/public/FRNoticesListLayout.aspx.</E> <FTNT> <SU>5</SU>   <E T="03">Id.</E> </FTNT> <HD SOURCE="HD1">Changes Since the Preliminary Results</HD> Based on a review of the record and comments received from interested parties regarding our <E T="03">Preliminary Results,</E> we made certain changes to the margin calculations for Hyundai Steel Company (Hyundai) and POSCO/POSCO International Corporation (collectively, POSCO). <SU>6</SU> <FTREF/> <FTNT> <SU>6</SU>  For a full description of changes, <E T="03">see</E> Issues and Decision Memorandum. </FTNT> <HD SOURCE="HD1">Rate for Respondents Not Selected for Individual Examination</HD> Generally, Commerce looks to section 735(c)(5) of the Act, which provides instructions for calculating the all-others rate in an investigation, for guidance when calculating the weighted-average dumping margin for respondents that were not individually examined in an administrative review. Section 735(c)(5)(A) of the Act provides that the all-others rate should be calculated by weight averaging the weighted-average dumping margins determined for individually examined respondents, excluding rates that are zero, <E T="03">de minimis,</E> or based entirely on facts available. The final weighted-average dumping margins calculated for Hyundai and POSCO are not zero, <E T="03">de minimis,</E> or based entirely on facts available. Therefore, consistent with section 735(c)(5)(A) of the Act, we calculated a weighted-average dumping margin for KG Dongbu Steel Co., Ltd. (Dongbu) using the calculated rates of the mandatory respondents, Hyundai and POSCO, which are not zero or <E T="03">de minimis,</E> or determined entirely on the basis of facts available. <SU>7</SU> <FTREF/> <FTNT> <SU>7</SU>   <E T="03">See</E> Memorandum “Calculation of the Review-Specific Average Rate for the Final Results,” dated concurrently with this notice. </FTNT> <HD SOURCE="HD1">Final Results of Review</HD> As a result of this review, we determine the following estimated weighted-average dumping margins for the period September 1, 2021, through August 31, 2022: <GPOTABLE COLS="2" OPTS="L2,nj,tp0,i1" CDEF="s25,9"> <TTITLE> </TTITLE> <CHED H="1">Producer or exporter</CHED> <ENT>0.88</ENT> </ROW> <ROW> <ENT I="01">POSCO/POSCO International Corporation</ENT> <ENT>2.70</ENT> </ROW> <ROW> <ENT I="01">KG Dongbu Steel Co., Ltd</ENT> <ENT>2.13</ENT> </ROW> </GPOTABLE> <HD SOURCE="HD1">Disclosure</HD> Commerce intends to disclose to interested parties the calculations performed for Hyundai and POSCO in connection with these final results of review within five days of the date of publication of this notice, in accordance with 19 CFR 351.224(b). <HD SOURCE="HD1">Assessment Rate</HD> Pursuant to section 751(a)(2)(C) of the Act and 19 CFR 351.212(b), Commerce will determine, and U.S. Customs and Border Protection (CBP) shall assess, antidumping duties on all appropriate entries of subject merchandise covered by the final results of this review. Commerce intends to issue assessment instructions to CBP no earlier than 35 days after the date of publication date of the final results of this review in the <E T="04">Federal Register</E> . If a timely summons is filed at the U.S. Court of International Trade, the assessment instructions will direct CBP not to liquidate relevant entries until the time for parties to file a request for a statutory injunction has expired ( <E T="03">i.e.,</E> within 90 days of publication). Because Hyundai and POSCO reported the entered value of their U.S. sales, we calculated importer-specific <E T="03">ad valorem</E> assessment rates based on the ratio of the total amount of dumping calculated for each importer's examined sales to the total entered value of such sales. <SU>8</SU> <FTREF/> Where an importer-specific <E T="03">ad valorem</E> assessment rate is zero or <E T="03">de minimis,</E> or a respondent's weighted-average dumping margin is zero or <E T="03">de minimis,</E> Commerce will instruct CBP to liquidate appropriate entries without regard to antidumping duties. <SU>9</SU> <FTREF/> <FTNT> <SU>8</SU>   <E T="03">See</E> 19 CFR 351.212(b)(1). </FTNT> <FTNT> <SU>9</SU>   <E T="03">See</E> 19 CFR 351.212(c)(2). </FTNT> Commerce's “automatic assessment” practice will apply to entries of subject merchandise during the POR produced by Hyundai or POSCO for which the reviewed companies did not know that the merchandise they sold to the intermediary ( <E T="03">i.e.,</E> a reseller, trading company, or exporter) was destined for the United States. <SU>10</SU> <FTREF/> In such instances, we will instruct CBP to liquidate unreviewed entries at the all-others rate if there is no rate for the intermediate company(ies) involved in the transaction. <SU>11</SU> <FTREF/> <FTNT> <SU>10</SU>  For a full discussion of this practice, see <E T="03">Antidumping and Countervailing Duty Proceedings: Assessment of Antidumping Duties,</E> 68 FR 23954 (May 6, 2003). </FTNT> <FTNT> <SU>11</SU>   <E T="03">See Order,</E> 81 FR at 64434. </FTNT> For Dongbu, the company that was not selected for individual examination, we assigned an assessment rate based on the weighted average of the cash deposit rates calculated for Hyundai and POSCO, excluding any which are zero, <E T="03">de minimis,</E> or determined entirely on the basis of facts available. <SU>12</SU> <FTREF/> <FTNT> <SU>12</SU>   <E T="03">See</E> section 735(c)(5)(A) of the Act. </FTNT> <HD SOURCE="HD1">Cash Deposit Instructions</HD> The following cash deposit requirements will be effective for all shipments of the subject merchandise entered, or withdrawn from warehouse, for consumption on, or after, the date of publication of this notice in the <E T="04">Federal Register</E> , as provided for by section 751(a)(2)(C) of the Act: (1) the cash deposit ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ Preview showing 10k of 14k characters.
