<NOTICE> DEPARTMENT OF COMMERCE <SUBAGY>International Trade Administration</SUBAGY> <DEPDOC>[C-489-819]</DEPDOC> <SUBJECT>Steel Concrete Reinforcing Bar From the Republic of Türkiye: Preliminary Results and Partial Rescission of Countervailing Duty Administrative Review; 2022</SUBJECT> <HD SOURCE="HED">AGENCY:</HD> Enforcement and Compliance, International Trade Administration, Department of Commerce. <SUM> <HD SOURCE="HED">SUMMARY:</HD> The U.S. Department of Commerce (Commerce) preliminarily determines that countervailable subsidies were provided to producers and exporters of steel concrete reinforcing bar (rebar) from the Republic of Türkiye (Türkiye) during the period of review (POR) January 1, 2022, through December 31, 2022. Additionally, Commerce is rescinding this review with respect to six companies. For a complete description of the scope of the Order, see the Preliminary Decision Memorandum. <HD SOURCE="HD1">Methodology</HD> Commerce is conducting this review in accordance with section 751(a)(1)(A) of the Act. For each of the subsidy programs found countervailable, we preliminarily find that there is a subsidy, <E T="03">i.e.,</E> a financial contribution that gives rise to a benefit to the recipient, and the subsidy is specific. <SU>8</SU> <FTREF/> For a full description of the methodology underlying our conclusions, see the Preliminary Decision Memorandum. <FTNT> <SU>8</SU>   <E T="03">See</E> sections 771(5)(B) and (D) of the Act regarding financial contribution; section 771(5)(E) of the Act regarding benefit; and section 771(5A) of the Act regarding specificity. </FTNT> <HD SOURCE="HD1">Companies Not Selected for Individual Examination</HD> The Act and Commerce's regulations do not directly address the subsidy rate to be applied to companies not selected for individual examination where Commerce limits its examination in an administrative review pursuant to section 777A(e)(2) of the Act. However, Commerce normally determines the rates for non-selected companies in reviews in a manner that is consistent with section 705(c)(5) of the Act, which provides instructions for calculating the all-others rate in an investigation. Section 777A(e)(2) of the Act provides that “the individual countervailable subsidy rates determined under subparagraph (A) shall be used to determine the all-others rate under section 705(c)(5) {of the Act}.” Section 705(c)(5)(A) of the Act states that for companies not investigated, in general, we will determine an all-others rate by weight averaging the countervailable subsidy rates established for each of the companies individually investigated, excluding zero and <E T="03">de minimis</E> rates or any rates based solely on the facts available. In this administrative review, Commerce preliminarily calculated a <E T="03">de minimis</E> rate for Icdas Celik Enerji Tersane ve Ulasim Sanayi A.S. Therefore, the only rate that is not zero, <E T="03">de minimis,</E> or based entirely on facts otherwise available is the preliminary rate calculated for Kaptan Demir Celik Endustrisi ve Ticaret A.S. (Kaptan). Consequently, for these preliminary results, we are assigning Colakoglu Metalurji A.S. the rate calculated for Kaptan. <HD SOURCE="HD1">Rescission of Administrative Review, in Part</HD> Commerce's practice is to rescind an administrative review of a CVD order, pursuant to 19 CFR 351.213(d)(1), when the interested party that requested a review withdraws the request within 90 days of publication of the notice of initiation of the requested review. Commerce received timely-filed withdrawal requests with respect to six companies, pursuant to 19 CFR 351.213(d)(1): (1) Ans Kargo Lojistik Tas ve Tic Baykan Dis Ticaret; (2) Baykan Dis Ticaret; (3) Kibar dis Ticaret A.S.; (4) Meral Makina Iml Ith Ihr Gida; (5) Sami Soybas Demir Sanayi ve Ticaret; and (6) Yucel Boru Ihracat Ithalat ve Pazarlama. <SU>9</SU> <FTREF/> Because the withdrawal requests were timely filed, and no other party requested a review of these companies, in accordance with 19 CFR 351.213(d)(1), Commerce is rescinding this review with respect to these six companies. <FTNT> <SU>9</SU>   <E T="03">See</E> Petitioner's Letter, “Partial Withdrawal of Request for Administrative Review,” dated January 22, 2024. </FTNT> <HD SOURCE="HD1">Preliminary Results of Review</HD> As a result of this review, we preliminarily determine the following net countervailable subsidy rates for the period January 1, 2022, through December 31, 2022: <GPOTABLE COLS="2" OPTS="L2,tp0,p7,7/8,i1" CDEF="s40,r30"> <TTITLE> </TTITLE> <CHED H="1">Company</CHED> <CHED H="1"> Subsidy rate (percent ad valorem) </CHED> <ROW> <ENT I="01">Icdas Celik Enerji Tersane ve Ulasim Sanayi A.S</ENT> <ENT> 0.14 ( <E T="03">de minimis</E> ). </ENT> </ROW> <ROW> <ENT I="01">Kaptan Demir Celik Endustrisi ve Ticaret A.S</ENT> <ENT>2.54.</ENT> </ROW> <ROW> <ENT I="01">Colakoglu Metalurji A.S</ENT> <ENT>2.54.</ENT> </ROW> </GPOTABLE> <HD SOURCE="HD1">Disclosure and Public Comment</HD> Commerce intends to disclose its calculations performed to interested parties for these preliminary results within five days of any public announcement or, if there is no public announcement, within five days of the date of publication of this notice in the <E T="04">Federal Register</E> in accordance with 19 CFR 351.224(b). Pursuant to 19 CFR 351.309(c), interested parties may submit case briefs to Commerce no later than 30 days after the date of publication of this notice. Rebuttal briefs, limited to issues raised in the case briefs, may be filed not later than five days after the date for filing case briefs.
