<NOTICE> DEPARTMENT OF COMMERCE <SUBAGY>International Trade Administration</SUBAGY> <DEPDOC>[A-570-110]</DEPDOC> <SUBJECT>Vertical Metal File Cabinets From the People's Republic of China: Final Results of the Expedited First Sunset Review of the Antidumping Duty Order</SUBJECT> <HD SOURCE="HED">AGENCY:</HD> Enforcement and Compliance, International Trade Administration, Department of Commerce. <SUM> <HD SOURCE="HED">SUMMARY:</HD> As a result of the expedited sunset review, the U.S. Department of Commerce (Commerce) finds that revocation of the antidumping duty (AD) order on vertical metal file cabinets (file cabinets) from the People's Republic of China (China) would likely lead to the continuation or recurrence of dumping at the levels indicated in the “Final Results of Sunset Review” section of this notice. </SUM> <DATES> <HD SOURCE="HED">DATES:</HD> Applicable February 24, 2025. </DATES> <FURINF> <HD SOURCE="HED">FOR FURTHER INFORMATION CONTACT:</HD> Thomas Martin, AD/CVD Operations, Office IV, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce, 1401 Constitution Avenue NW, Washington, DC 20230; telephone: (202) 482-3299. </FURINF> <SUPLINF> <HD SOURCE="HED">SUPPLEMENTARY INFORMATION:</HD> <HD SOURCE="HD1">Background</HD> On December 13, 2019, Commerce published the AD order on file cabinets from China. <SU>1</SU> <FTREF/> On November 4, 2024, Commerce published the notice of initiation of the five-year sunset review of the <E T="03">Order,</E> pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act). <SU>2</SU> <FTREF/> On November 12, 2024, Commerce received a notice of intent to participate in this sunset review from Hirsh Industries LLC (the domestic interested party) within the deadline specified in 19 CFR 351.218(d)(1). <SU>3</SU> <FTREF/> The domestic interested party claimed interested party status under section 771(9)(C) of the Act as a manufacturer, producer, or wholesaler of a domestic like product in the United States. <FTNT> <SU>1</SU>   <E T="03">See Vertical Metal File Cabinets from the People's Republic of China: Antidumping and Countervailing Duty Orders,</E> 84 FR 68121 (December 13, 2019), as corrected in <E T="03">Vertical Metal File Cabinets from the People's Republic of China: Correction to Antidumping and Countervailing Duty Orders,</E> 85 FR 3611 (January 22, 2020) (collectively, <E T="03">Order</E> ). </FTNT> <FTNT> <SU>2</SU>   <E T="03">See Initiation of Five-Year (Sunset) Reviews,</E> 89 FR 87543 (November 4, 2024). </FTNT> <FTNT> <SU>3</SU>   <E T="03">See</E> Domestic Interested Party's Letter, “Domestic Interested Party Notice of Intent to Participate,” dated November 12, 2024. </FTNT> On December 2, 2024, the domestic interested party filed a timely substantive response within the deadline specified in 19 CFR 351.218(d)(3)(i). <SU>4</SU> <FTREF/> Commerce received no substantive responses from any other interested parties, nor was a hearing requested. On November 25, 2024, Commerce notified the U.S. International Trade Commission (ITC) that it did not receive an adequate substantive response from respondent interested parties. <SU>5</SU> <FTREF/> As a result, pursuant to section 751(c)(3)(B) of the Act and 19 CFR 351.218(e)(1)(ii)(C)(2), Commerce conducted an expedited (120-day) sunset review of the <E T="03">Order.</E> <FTNT> <SU>4</SU>   <E T="03">See</E> Domestic Interested Party's Letter, “Domestic Interested Party's Substantive Response,” December 2, 2024 (Substantive Response). </FTNT> <FTNT> <SU>5</SU>   <E T="03">See</E> Commerce's Letter, “Sunset Reviews Initiated on November 4, 2024,” dated November 25, 2024. </FTNT> <HD SOURCE="HD1">Scope of the Order</HD> The merchandise subject to the <E T="03">Order</E> is file cabinets. For a complete description of the scope of the <E T="03">Order, see</E> the Issues and Decision Memorandum. <SU>6</SU> <FTREF/> <FTNT> <SU>6</SU>   <E T="03">See</E> Memorandum, “Issues and Decision Memorandum for the Final Results of the First Expedited Sunset Review of the Antidumping Duty Order on Vertical Metal File Cabinets from the People's Republic of China (Issues and Decision Memorandum), dated concurrently with these results and hereby adopted by this notice. </FTNT> <HD SOURCE="HD1">Analysis of Comments Received</HD> All issues raised in this review, including the likelihood of continuation or recurrence of dumping in the event of revocation and the magnitude of the margins likely to prevail if the <E T="03">Order</E> were revoked, are addressed in the accompanying Issues and Decision Memorandum. <SU>7</SU> <FTREF/> A list of topics discussed in the Issues and Decision Memorandum is included as an appendix to this notice. The Issues and Decision Memorandum is a public document and is on file electronically via Enforcement and Compliance's Antidumping and Countervailing Duty Centralized Electronic Service System (ACCESS). ACCESS is available to registered users at <E T="03">https://access.trade.gov.</E> In addition, a complete version of the Issues and Decision Memorandum can be accessed at <E T="03">https://access.trade.gov/public/FRNoticesListLayout.aspx.</E> <FTNT> <SU>7</SU>   <E T="03">Id.</E> </FTNT> <HD SOURCE="HD1">Final Results of Sunset Review</HD> Pursuant to sections 751(c)(1) and 752(c)(1) and (3) of the Act, Commerce determines that revocation of the antidumping duty order on file cabinets from China would be likely to lead to the continuation or recurrence of dumping, and that the magnitude of the margins likely to prevail would be weighted-average dumping margins up to 198.50 percent. <HD SOURCE="HD1">Administrative Protective Order (APO)</HD> This notice serves as the only reminder to interested parties subject to an APO of their responsibility concerning the return or destruction of proprietary information disclosed under APO in accordance with 19 CFR 351.305. Timely notification of the return or destruction of APO materials or conversion to judicial protective order is hereby requested.
