Interested parties are invited to comment on these preliminary results. </SUM> <DATES> <HD SOURCE="HED">DATES:</HD> Applicable October 10, 2024. </DATES> <FURINF> <HD SOURCE="HED">FOR FURTHER INFORMATION CONTACT:</HD> Caroline Carroll, AD/CVD Operations, Office IX, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce, 1401 Constitution Avenue NW, Washington, DC 20230; telephone: (202) 482-4948. </FURINF> <SUPLINF> <HD SOURCE="HED">SUPPLEMENTARY INFORMATION:</HD> <HD SOURCE="HD1">Background</HD> On September 20, 2016, Commerce published in the <E T="04">Federal Register</E> the antidumping duty order on cold-rolled steel from Korea. <SU>1</SU> <FTREF/> On September 6, 2023, Commerce published in the <E T="04">Federal Register</E> a notice of opportunity to request an administrative review of the <E T="03">Order</E> for the POR. <SU>2</SU> <FTREF/> On November 15, 2023, based on timely requests for review, in accordance with 19 CFR 351.221(c)(1)(i), we initiated an administrative review of the <E T="03">Order.</E> <SU>3</SU> <FTREF/> On December 20, 2023, Commerce selected Hyundai Steel Company (Hyundai) and POSCO/POSCO International Corporation (collectively, POSCO) as the mandatory respondents in this administrative review. <SU>4</SU> <FTREF/> On May 17, 2024, we extended the deadline for issuing the preliminary results of this review to September 27, 2024, in accordance with section of 751(a)(3) of the Tariff Act of 1930 (the Act), and 19 CFR 351.213(h)(2). <SU>5</SU> <FTREF/> On July 22, 2024, Commerce tolled certain deadlines in this administrative proceeding by seven days. <SU>6</SU> <FTREF/> The deadline for the preliminary results is now October 4, 2024. For a complete description of the scope of the <E T="03">Order, see</E> the Preliminary Decision Memorandum. <HD SOURCE="HD1">Methodology</HD> Commerce is conducting this review in accordance with sections 751(a)(1)(B) and (2) of the Act. Export price and constructed export price are calculated in accordance with section 772 of the Act. NV is calculated in accordance with section 773 of the Act. For a full description of the methodology underlying our conclusions, <E T="03">see</E> the Preliminary Decision Memorandum. A list of the topics discussed in the Preliminary Decision Memorandum is attached as an appendix to this notice. The Preliminary Decision Memorandum is a public document and is on file electronically via Enforcement and Compliance's Antidumping and Countervailing Duty Centralized Electronic Service System (ACCESS). ACCESS is available to registered users at <E T="03">https://access.trade.gov.</E> In addition, a complete version of the Preliminary Decision Memorandum can be accessed directly at <E T="03">https://access.trade.gov/public/FRNoticesListLayout.aspx.</E> <HD SOURCE="HD1">Rate for Non-Examined Company</HD> The Act and Commerce's regulations do not address the establishment of a weighted-average dumping margin to be determined for companies not selected for individual examination when Commerce limits its examination in an administrative review pursuant to section 777A(c)(2) of the Act. Generally, Commerce looks to section 735(c)(5) of the Act, which provides instructions for calculating the all-others rate in a market economy less-than-fair-value (LTFV) investigation, for guidance when determining the weighted-average dumping margin for companies which were not selected for individual examination in an administrative review. Under section 735(c)(5)(A) of the Act, the all-others rate is normally “an amount equal to the weighted average of the estimated weighted average dumping margins established for exporters and producers individually investigated, excluding any zero or <E T="03">de minimis</E> margins, and any margins determined entirely {on the basis of facts available}.” In this review, we preliminarily calculated dumping margins of zero for both of the mandatory respondents. Consistent with the U.S. Court of Appeals for the Federal Circuit's decision in <E T="03">Albemarle,</E> <SU>8</SU> <FTREF/> and Commerce's practice, <SU>9</SU> <FTREF/> we are preliminarily applying to KG Dongbu Steel Co., Ltd. (KG Dongbu), the company not selected for individual examination in this review, a margin of zero percent, because we preliminarily calculated rates of zero percent for both mandatory respondents, Hyundai and POSCO, pursuant to section 735(c)(5)(B) of the Act. <FTNT> <SU>8</SU>   <E T="03">See Albemarle Corp.</E> v. <E T="03">United States,</E> 821 F.3d 1345 (Fed. Pursuant to 19 CFR 351.309(c), interested parties may submit case briefs no later than 30 days after the date of publication of this notice.
